ritiene utile informare tutti i consorziati che, con l&#8217;entrata in vigore del D.Lgs nr 116 del 03.09.2020 che modifica il TESTO UNICO AMBIENTALE nr 152\/2006, ovvero all&#8217;art. 9 comma 6.b-sexies, viene chiaramente indicato che i rifiuti prodotti dalle fosse settiche sebbene non pericolosi non sono equiparati pi\u00f9 ai rifiuti urbani.<\/p>\n<p>Pur se allo stato non vi sono pronunce in tal senso si ritiene utile consigliare l\u2019adozione di una prassi cautelativa per prevenire l\u2019applicazione si sanzioni da parte degli organi preposti.<\/p>\n<p>Pertanto con riferimento sempre allo stesso D.Lgs nr 116\/2020 all&#8217;art. 14 comma 2.b essi devono essere smaltiti massimo entro l&#8217;anno dall&#8217;ultimo smaltimento, INDIPENDENTEMENTE DALLA QUANTITA&#8217;, ANCHE RESIDUALE, DEI FANGHI IN ESSO PRESENTE.<\/p>\n<p>Tale scadenza temporale vale anche per tutti i rifiuti prodotti da impianti di trattamento delle acque reflue, cos\u00ec come per tutti i rifiuti prodotti dal ciclo produttivo, semprech\u00e8 prima non vengano superati i relativi limiti quantitativi annui di accumulo.<\/p>\n<p>Ci risulta che le autorit\u00e0 di controllo (NOE) stanno gi\u00e0 verificando nella nostra area industriale tale adempimento verso alcuni opifici, in particolare la regolare pulizia e smaltimento ENTRO L&#8217;ANNO DALL&#8217;ULTIMO SMALTIMENTO dei rifiuti prodotti da impianti di trattamento delle acque\u00a0reflue, ovvero dei fanghi delle fosse settiche.<\/p>\n<p>Considerato che il testo della legge \u00e8 entrato in vigore il 18.9.2020 si consiglia di procedere alla pulizia conservando il formulario entro il 18.9.2021<\/p>\n<p>Si invita quindi di verificare tale adempimento, visto che \u00e8 consuetudine per molti di farlo ancora oggi, quando le vasche di accumulo dei fanghi siano quasi piene.<\/p>\n<p>La presente non sostituisce eventuali note e\\o provvedimento delle Autorit\u00e0.<\/p>\n<p>I singoli consorziati sono invitati a
